Hehe... Well technically it's all illegal thanks to the WTO, national and international copyright laws, treaties, and such.
I think fansubs/rips etc. are more of a moral/practical choice since they are clearly legally verboten.
I don't think most of us go around buying cd's of music we haven't heard/previewed in some form or another. I'd say the same of dvd's of videos/movies be they anime or otherwise.
IMO there is a lack of an affordable, convenient, widely available, and legal mechanism to fullfill this function with anime right now and fansubs/rips fill this void. With the way things are going right now I don't think there will be either though I have heard buzz about dedicated anime cable channels coming (Who knows how widely available they'll be or what kind of diversity of content they'll make available.) There's also the manuverings and machinations of the MPAA/RIAA/Publishing Houses to make pay per view sheeple out of us all which exacerbates things to no end. Crap! </rant>

Of course, maybe folks with tons of money do buy lots of dvd's sight unseen but I'm not one of those folks so I wouldn't know for sure. If anyone would volunteer to give me a few million $ I'd be willing to be a test subject in a study.
The dilemma that drives me to fansubs/rips (and a very grey moral justification of my own consumption) is that there's very little available on tv (what there is is usually badly butchered by censors [thanks CN]) and I live in a small town which gives me few choices rental wise. In my 'hick' town there are 2 national video rental chain stores (Blockbuster & Movie Gallery) but they have maybe 10 anime titles between them. Damn 'hick' Philistines!
There is also the lamest of excuses, which is that I am currently one of the 'poor & unwashed masses' (though I tend to be washed more often than not).
If it wasn't for fansubs/rips I would really have no clue as to how varied and interesting an art form anime is. Sadly I am forced by nature to prefer food over art as a practical matter. I'm sure some would say I should go without till I can afford to buy but patience in not an American virtue. I Want It Now Damnit!!! This also goes to the very anoying amount of time it takes for that anime which does get licenced for distribution in R1 to actually get released. This situation is a result of the lameness and corporate greed that is the dvd 'region' encoding scheme. (OK, well that might be more my bitterness talking. ..)
Now if only the Japanese anime houses and thier distributors would sub all thier R2 releases in english they could cut out the middle men and do a higher volume in world wide sales (hopefully resulting in the lowering of relatively high Japanese dvd prices to us gaijin).
Damn I shouldn't write when I'm woozy-tired. Sorry for the long rambling post but I'm going to press this damn submit button cuz this is just too much typing to consign to oblivion.

I tend to lean towards the line of thinking that says that arguments about what should and shouldn't be posted because of lisencing and copyright laws don't really have a place on binary Usenet newsgroups, which are by their very nature in the heart of the Pirate Ship in the high seas of the Internet. If you want to get right down to the nitty-gritty of it, even UNliscenced digisubs are technically unethical and ripping off the companies who originally produced them, drawing the line *here* but not *there* on the ethics of what can be stolen when and under what circumstances is just a way that some people can talk themselves around in circles until they have clear consciences about what is still no matter how you slice it, dice it or make Julienne fries with it, theft.
Me, I say if you're going to be a pirate don't sit around and beat yourself up about it or try to convince yourself that you're some kind of digital anime equivalent of Robin Hood. Put on your damn parrot and your peg leg and be a PIRATE. Come on, say it with me, it'll make you feel better...

I don't have a parrot. My ears aren't pierced (gold hoop pirate earing enabled). I'm not a gimp. I do have a full beard however.
I could catch a bird and tie it to my shoulder (I was thinking a mocking bird might be an appropriate choice). I can get a clip on gold earing. I can make an eye patch (wear it on my bird mounted side as protecting from said, now angry, bird). I'm not cutting off a leg but I can fake a passable limp. But... I draw the line at tying ribbons in my beard!

Oh, I wasn't debating that. I was just wondering why (inc) thought this episode was any *more* illegal than usual.
